Products available for sale on this website are subject to these terms and conditions. By purchasing Products on this website you agree to be bound by these terms and conditions. We reserve the right to change these terms and conditions at any time, and you are bound by the version available on the site at the date of purchase. Your statutory rights are not affected by these terms and conditions. These terms and conditions include our Privacy Policy.

Indemnity
You agree to fully indemnify us, our officers, employees, agents and suppliers, immediately on demand, from and against all claims, liability, damages, losses, costs and expenses arising out any breach by you of these terms and conditions or by your use of this website, or the use of any other person accessing this website using your shopping account or your Personal Information.

Links
Our Web site may provide links to third party sites (Golf Club websites for example). Please be aware that we are not responsible for the content, use or privacy practices of other sites. We are not liable for any damage, loss or offence caused by, or in connection with, the use of or reliance on any information, goods or services available on other sites. We encourage our users to be aware when they leave our site and to read the terms and conditions, and privacy statements of each and every web site that they visit.

Prices
All prices stated on the website are inclusive of VAT, but exclusive of delivery charges, unless we tell you otherwise. Prices and availability of products may be changed at any time without notice. The price at which you agree to purchase the Products is the price stated on this website at the time you place your order.

Colours
We make every effort to ensure that the images of the products on our website are accurate. However because of differences between monitors the colour you see of the product may not accurately reflect its true colour.

Availability
We make every effort to ensure that our site has up-to-date information about product availability. If an item is not in stock at the time you place an order, we will ship the Products within 21 days (subject to supplier stock)(UK only).

Orders
We will take all reasonable steps to ensure that your credit or debit card information (Confidential Information) is kept secure. However unless we have been negligent, we are not liable for any losses arising from unauthorised access by a third party to your Confidential Information.

Acceptance
Once you have placed an order on this website, we will send you an email confirming the order you have made. We will not accept the order and complete the contract until we despatch the Products ordered. If there is a problem with your order, eg. a problem with your credit card or our suppliers do not have the Products ordered in stock, and we cannot complete the contract, we will tell you by email.

Payment
Where payment is made by credit or debit card, you authorise us to debit your card with the total cost of the Products selected plus VAT and delivery charges. Any refunds made in respect of returns or cancellations will be made to the same card. Where payment has not been made in full, we may cancel your order and/or suspend any further deliveries to you. Liability We are not liable for loss of profits, loss of business or other consequential, special or indirect loss, costs, expenses or other claims for compensation, whether caused by our negligence or not, arising out of or in connection with the Products or their use or resale by you. We are not liable to pay you any compensation other than a refund equal to the price of the Products that you have paid us for.
This clause is not intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence. The risk of damage or loss of the Products passes to you when delivery is made. We cannot accept any claims beyond this point. All implied warranties and undertakings are excluded to the maximum extent permitted by law.

Delivery
We will deliver to the address specified by you in your order using our chosen carrier. We will make every effort to ensure that your order is delivered within 5 working days provided the Products are in stock and 21 days (UK ONLY) if we have to ship the products. However any dates for delivery are approximate only and we are not liable for any delay in delivering your order or any part of it. We may choose to deliver your order in separate parts. If you do not take delivery of your order or you do not supply adequate delivery information, we may cancel your order and retain the Products. In this event we will refund the price of the Products but you will be liable to pay the delivery charge, including any surcharge we may need to pay our delivery company. If there is a problem with the delivery of your order, you must tell us in writing within 14 days after the delivery date. We will not be liable for any loss or damage if you do not do this.

Cancellation
You may cancel your contract by giving us notice of cancellation within 7 working days of the Products being delivered. You must tell us that you are cancelling your order by:

When you are cancelling your order, please give us the following information:
• your order number to help us track your order;
• the number and description of the items you are returning; and
• the reason for returning the Products (eg. because the Products were the wrong size or faulty).

We will then send you by email a Returns Number.

You must return the Products at your cost to us at the address provided on the invoice sent to you. The Products must be in their original packaging and in a condition that would enable us to sell those Products to someone else as new. In the case of footwear, this means that the footwear must not have been worn outside or treated in any way. Please include your order number and Returns Number with the Products.

We will refund the price of the Products, unless the product is defective or we sent you the wrong Products, in which case we will also refund your return costs once we have received proof of those costs from you.

Errors and Omissions
We have made every effort to ensure that the information on this website and in any documentation we may send you (Information) is accurate. However we do not make any promises about the Information and we are not liable for any loss or damage, whether direct, indirect or consequential, which may happen as a result of relying on the Information, except where we are not allowed by law to exclude our liability.

Force Majeure
We are not liable to you for any failure or delay to supply or deliver or for any damage or defect to the Products that is caused by any event or circumstance beyond our reasonable control.

General
If any part of these conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you), the validity, legality or enforceability of any other part of these conditions will not be affected. This agreement is governed by English law. We do not give any contractual rights to third parties, and the Contracts (Rights of Third Parties) Act 1999 will not apply to any contract between us. This website may contain links to other websites not under our control. We do not accept any responsibility or liability for material on those websites. The naming on the website of other companies, organisations or products does not imply endorsement by us.
